All products are subject to availability. MassMulch reserves the right to:

• Limit quantities
• Cancel orders due to supply or operational limitations

Customers will be notified if an order cannot be fulfilled as requested.

3. Natural Material Variations

Many products sold by MassMulch are natural materials and may vary in:

• Color
• Texture
• Moisture content
• Particle size
• Organic composition

Product images are for general reference only and may not exactly represent delivered material. These variations are normal and do not qualify as defects.

4. Material Estimates

Material calculators, coverage guides, and estimates are provided for general reference only.

Actual quantities required may vary due to:

• Site conditions
• Installation methods
• Compaction
• Waste factors

MassMulch is not responsible for overages or shortages resulting from estimated calculations.

5. Pricing & Payment

All pricing is subject to change without notice.

Orders are considered confirmed only after:

• Payment is processed, or
• Payment is accepted (cash/check at delivery when applicable)

By placing an order, you authorize MassMulch to charge the provided payment method for all applicable costs, including materials, delivery fees, and taxes.

MassMulch reserves the right to:

• Correct pricing errors
• Refuse, cancel, or limit any order at its discretion

6. Sales Tax

Applicable sales tax will be charged in accordance with Massachusetts law. Customers are responsible for all applicable taxes.

7. Delivery Terms & Site Responsibility

Customers are responsible for ensuring delivery locations are safe and accessible.

By scheduling delivery, the customer acknowledges:

• Delivery areas must be suitable for large trucks
• The driver has final discretion on safe placement of materials
• Once materials are dumped, they cannot be moved or reloaded

MassMulch is not responsible for damage to:

• Driveways
• Curbs
• Lawns
• Underground utilities (including septic systems, irrigation, etc.)
• Any property affected during delivery when access is provided

Customers are responsible for:

• Clearly marking delivery locations
• Identifying hazards such as overhead wires or soft ground conditions

Delivery times are estimates and may be affected by weather, traffic, equipment issues, or operational factors.

8. Pickup Orders

Customers picking up materials are responsible for:

• Providing a suitable vehicle or trailer
• Ensuring proper load capacity
• Securing materials before leaving the property

MassMulch is not responsible for damages or incidents after materials are loaded.

9. Returns, Cancellations & Refunds

Due to the nature of bulk materials, all sales are final unless otherwise approved at the sole discretion of MassMulch.

• Delivered materials that have been dumped cannot be returned
• Approved refunds will be issued by check within a reasonable timeframe, typically within 7-10 business days

Customers must contact MassMulch promptly if there is an issue with an order.

10. Payment Issues & Fees

• A $30 fee will be charged for any check returned by a financial institution due to insufficient funds or other processing failure.
• If a customer places a stop payment on a check after goods or services have been provided, a $50 administrative fee will be applied to cover bank and processing costs.
• If a credit card dispute or chargeback is initiated without first contacting us to resolve the issue, and the dispute is found to be invalid or resolved in our favor, a $50 chargeback processing fee may be applied.

MassMulch makes reasonable efforts to maintain accurate information but does not guarantee that all content is complete, current, or error-free.

Contractor Terms & Conditions

Contractor Pricing

Contractor pricing may differ from retail pricing and is considered confidential.

Contractors agree not to:

• Share pricing publicly
• Publish pricing online
• Distribute pricing to non-approved parties

MassMulch reserves the right to modify contractor pricing at any time.

Contractor Eligibility

Contractor accounts are intended for business use only. MassMulch may approve, deny, or revoke accounts at its discretion.

Contractors may be required to provide:

• Business information
• Contact details
• Tax identification (if applicable)

Ordering & Payment

Contractor orders may be placed online, in person, or by phone (at our discretion).

Unless otherwise agreed in writing, payment is due at the time of purchase.

Failure to meet payment terms may result in account suspension.

Product Responsibility

Contractors are responsible for ensuring materials meet project requirements prior to installation.

Natural variations in materials are normal and not considered defects.

Delivery Responsibility

Contractors are responsible for:

• Ensuring job site accessibility
• Communicating delivery risks to their customers
• Providing accurate delivery instructions

Final material placement is determined by the driver for safety reasons.

Account Termination

MassMulch may suspend or terminate contractor accounts for:

• Non-payment
• Misuse of pricing
• Violation of Terms
• Fraud or harmful conduct

Contractor Liability

Contractors assume full responsibility for the use, installation, and performance of materials.

MassMulch is not liable for project outcomes or damages related to contractor use of materials.
