This policy explains how delivery services, cancellations, refunds, and order adjustments are handled by MassMulch. By placing an order (online, by phone, or in person), you agree to the terms outlined below.

Because many of our products are bulk landscape materials, special conditions apply.

Customers must report any order issues within 24 hours of delivery or pickup by contacting sales@massmulch.com.

1. Delivery Service Area

MassMulch provides delivery services to select cities and towns primarily north of Boston, Massachusetts.

Delivery availability depends on:

• Location
• Product and quantity
• Delivery schedule
• Weather conditions
• Equipment availability

Additional out-of-zone fees may apply depending on delivery location and will be communicated prior to order confirmation.

2. Delivery Scheduling

Delivery dates and time windows are estimates only and are not guaranteed.

Delays may occur due to:

• Weather conditions
• Traffic
• Equipment availability
• Order volume
• Job site accessibility

MassMulch is not responsible for delays caused by these factors.

Customers are responsible for ensuring the delivery site is prepared prior to delivery.

3. Delivery Access Requirements

Customers are responsible for ensuring that the delivery location is safe and accessible for large commercial trucks.

Customers must ensure:

• Adequate driveway width and clearance
• No parked vehicles blocking access
• No low wires, tree branches, or overhead obstructions
• A safe and suitable unloading area

Failure to be reachable in the event of an access issue may result in:

• Materials being dumped at the driver’s discretion, or
• The delivery being treated as a failed delivery

4. Dump Location & Placement

Customers may request a preferred dump location; however:

• Final placement is determined by the driver based on safety and accessibility
• MassMulch does not guarantee placement in the exact requested location
• Materials cannot be moved or reloaded once dumped

Customers should clearly mark or communicate the desired drop location prior to delivery.

5. Truck Weight & Property Risk

Delivery trucks may weigh up to 53,000 pounds or more when loaded.

Heavy vehicles may cause damage to certain surfaces, including but not limited to:

• Driveways
• Sidewalks
• Curbs
• Lawns
• Septic systems
• Underground utilities
• Irrigation systems

By requesting delivery, the customer acknowledges:

• They have assessed site conditions
• Their property can support delivery vehicles

MassMulch is not responsible for property damage resulting from normal delivery operations when access is approved by the customer.

6. Off-Driveway Deliveries

Off-driveway deliveries are not standard and must be approved in advance.

Additional terms and conditions apply and must be agreed to prior to delivery by filling out our [Off The Driveway Waiver].

7. Failed Deliveries & Delay Fees

If a delivery cannot be completed upon arrival due to site conditions, access issues, or inability to proceed, the following “unable to deliver” fees will apply (plus any out-of-zone fees):

• $80 — 1–6 yards
• $140 — 7–12 yards
• $175 — 13–16 yards
• $225 — 17+ yards (per truckload)

If the dump location is unclear and the contact person cannot be reached, the driver may:

• Dump materials in a safe location, or
• Return to the yard and treat the order as a failed delivery

Delivery delays caused by:

• Site access issues
• Unclear instructions
• Inability to contact the customer

may result in a delay fee of $200 per hour, prorated from the time the driver arrives on site.

8. Weather Delays

MassMulch reserves the right to reschedule deliveries due to:

• Severe weather
• Unsafe driving conditions
• Job site conditions affected by weather

Customers will be notified if rescheduling is required.

9. Bulk Material Sales Finality

Due to the nature of bulk materials:

• All sales are final once materials are delivered or loaded
• Materials that have been dumped or loaded cannot be returned

10. Order Changes & Cancellations

Customers must contact MassMulch as soon as possible to request changes or cancellations.

• Changes may not be possible once materials are loaded or dispatched
• Delivery fees and other charges may still apply

To avoid complications:

• Cancellation requests must be received before 4:00 PM on the day prior to the scheduled delivery date

If a cancellation is approved after payment has been processed, or if delivery cannot be completed due to customer-related issues:

• Applicable delivery fees, out-of-zone fees, or failed delivery charges will be deducted first
• A 6% cancellation fee may be applied to cover non-refundable payment processing costs

MassMulch reserves the right to cancel or modify orders due to:

• Product availability
• Weather conditions
• Operational or safety concerns

11. Natural Product Variations

Many products sold by MassMulch are natural materials and may vary in:

• Color
• Texture
• Moisture content
• Particle size
• Organic composition

These variations are normal and do not qualify for refunds or returns.

Product images are for general reference only.

Customers are encouraged to visit our yard if they would like to view materials prior to ordering.

12. Returns & Refunds

Due to the nature of bulk materials:

• All sales are final
• Refunds are issued only at the sole discretion of MassMulch

If approved:

• Refunds will be issued by check
• Typically within 7–10 business days

Customers must contact MassMulch promptly if there is an issue with an order.

13. Payment Disputes

Customers should contact MassMulch directly to resolve any issues before initiating a payment dispute.

If a dispute is filed and resolved in favor of MassMulch, the customer may be responsible for administrative fees.

14. Payment Processing Fees

The following fees may apply:

• $30 — Returned check due to insufficient funds or other bank processing failure
• $50 — Stop payment placed on a check after goods or services have been provided
• $50 — Chargeback or dispute resolved in favor of MassMulch

Customers are responsible for unpaid balances and any reasonable collection, court, or legal costs where permitted by law.

15. No Warranty / Use of Materials

MassMulch makes no guarantees regarding:

• Product performance
• Installation results
• Suitability for a particular purpose

All materials are provided “as is.”
