Off The Driveway Waiver Form

Dump area location– We deliver products in driveways only, unless an “Off The Driveway Waiver” has been agreed to while you placed your online order.

Ideally, we look for a minimum of two car lengths long (approx. 35′), by 14′ wide and no overhead obstructions within 20′ of the ground in the dump area. This allows the truck to back up to the dump area, put dump body up and pull forward to get entire delivery out.

If you do not meet our dump area requirements, you need to let us know the measurements you do have at the time of placing the order.

Waiver-
If you, the purchaser, orders deliveries off the driveway, the purchaser assumes all liability for damage done to our truck, sidewalks, driveways, or any other property and agrees to indemnify the Seller against all liability. The Seller assumes no responsibility for damage to property when delivery is made off the driveway. If the truck is to get stuck, the purchaser agrees to pay a rate of $150.00 per hour if the truck is out of service, the cost to fix damage to our truck as well as all the fees associated with towing. A stuck truck can cost $350 dollars at a minimum and more if the tow truck is delayed or access to the truck is not direct. On some occasions a second tow truck could be needed and would significantly increase the cost of the tow. Do not submit the waiver if you have any doubts about the area. You are 100% liable as stated above. MassMulch gains nothing by going off the driveway and only does so to help our customers. In the event we do get stuck or have any issues and you do not take full responsibility; you will be charged an additional $500 as an inconvenience fee and will be liable for all legal costs that we may occur to handle the situation.
